Terms of Sale

Welcome to Jackson Handling Ltd. These Terms of Sale govern all purchases from [www.jacksonhandling.co.uk]. By placing an order, you agree to be bound by these terms.

1. Ordering Process

1.1 Custom-Made Products

  • Custom-made products are manufactured to order and cannot be cancelled, refunded, or returned, unless faulty.
  • Once production has started, orders cannot be modified.
  • Estimated lead times are provided at checkout but may be subject to change due to production demands.

1.2 Stock Items

  • Stock items are subject to availability and will be dispatched in line with the chosen shipping method.
  • If an item is out of stock, we will offer an alternative or a full refund.

2. Pricing & Payment Terms

2.1 Prices

  • All prices are in GBP (£) and exclude VAT unless otherwise stated.
  • We reserve the right to update prices, but changes will not affect confirmed orders.

2.2 Payment Terms

  • For all online orders, full payment is required at checkout before processing begins.
  • For trade accounts and invoiced orders, payment terms are strictly 30 days from the invoice date, unless otherwise agreed in writing.
  • Late Payments:
    • Interest will be charged at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
    • A fixed late payment compensation fee will be added as follows:
      • £40 for debts up to £999.99
      • £70 for debts between £1,000 - £9,999.99
      • £100 for debts over £10,000
  • Unpaid invoices may result in legal action and additional recovery costs.

3. Delivery & Risk

3.1 Shipping & Lead Times

  • Estimated delivery times are provided at checkout.
  • Custom orders may have extended lead times, which will be communicated upon order confirmation.

3.2 Risk & Ownership

  • Risk of damage or loss transfers to the customer upon delivery.
  • Ownership of goods remains with Jackson Handling Ltd until full payment has been received.

4. Returns, Refunds & Cancellations

4.1 Custom-Made Products

  • As all custom orders are made to your specifications, they cannot be returned or refunded, unless they are defective or not as described.
  • Any defects must be reported within 48 hours of receipt.

4.2 Stock Items

  • Stock items can be returned within 14 days if unused, in original packaging, and in resalable condition.
  • Customers must contact us for return authorisation before sending goods back.
  • Refunds will be processed within 14 days of receiving the returned item, minus any applicable restocking fees.

4.3 Faulty or Incorrect Products

  • If you receive faulty or incorrect goods, notify us within 48 hours of delivery with photographic evidence.
  • Depending on the issue, we may offer a replacement, refund, or repair.

4.4 Order Cancellations

  • Stock Items: Orders may be cancelled before dispatch for a full refund.
  • Custom Orders: Cancellations are not permitted once production has started.

5. Warranty & Liability

5.1 Warranty

  • All products are covered by warranty against manufacturing defects as stipulated when ordering.
  • The warranty does not cover normal wear and tear, misuse, or improper installation.

5.2 Liability

  • We are not responsible for indirect, consequential, or incidental damages arising from product use.
  • Our maximum liability is limited to the original purchase price.

6. Late Payments & Debt Recovery

  • If payment is overdue, we reserve the right to:
    • Charge interest at 8% above the Bank of England base rate.
    • Add a statutory compensation fee as per Section 2.2.
    • Refer unpaid debts to a collection agency, with recovery costs added to the outstanding balance.
    • Suspend future orders until outstanding balances are settled.

7. Force Majeure

Jackson Handling Ltd is not liable for delays or failures due to events beyond our control, including supply chain disruptions, legal changes, or natural disasters.

8. Governing Law & Dispute Resolution

  • These terms are governed by UK law.
  • Any disputes will be subject to the exclusive jurisdiction of UK courts.
